By now most of you have heard of the capture and arrest of Eric Rudolph. Eric Rudolph was noticed by rookie Murphy, North Carolina police officer, Jeffrey Postell going through a dumpster outside a grocery store on May 31. Postell didn't recognize Rudolph at the scene, but thought he looked suspicious. Needing a "reason" to detain the unknown person, Postell charged Rudolph with attempted burglary, (For going through a dumpster!?), and brought him into the police station. It was there that another officer recognized Rudolph from the posters plastered everywhere in the southwestern North Carolina area.


Eric Rudolph has been evading federal forces since a man hunt for him began five years ago. Since that time federal agencies have descended upon the southern North Carolina area. They have made their reputation as arrogant ruffians who love to flash their badges and push the local populace around. This behavior has won many locals over to Rudolph's cause.


Using ground search tactics, blood hounds, helicopters equipped with FLIRS and thermal imaging, satellite tracking systems, road blocks, check points and totalitarian police state tactics, the army of multiple federal agencies came up empty in their search, but continued to occupy that portion of North Carolina for the five years that Eric Rudolph was on the run.


Rudolph has been charged with the Olympic Park bombing in Atlanta, Georgia, the bombing of a string of abortion mills and the bombing of a queer night club, along with two deaths in connection with the bombings.


I cannot condone, nor, I am sure, does the editors and contributors of The Independent American, ill-planned bombings of non-combatant targets which cause the deaths of Americans. This is simply a waste and it is evil. However, let us remember that Eric Rudolph has not been convicted or even tried for this crime as yet.


Regardless of American ideas of fairness and justice, Rudolph's case is already being tried in the media. Staying true to it's modis operandi, main stream, (read that government controlled), press began a smear campaign designed to assassinate Rudolph's character and spin him as an evil person.


Thus far, no evidence has been presented to the American public that Rudolph actually manufactured or planted any bombs. That is what the entire criminal charges against Rudolph will entail. What is being played out in the press is something different.


The controlled press has reported on the charges, yet has not qualified that Rudolph has not been proven guilty of them. The controlled press, then continues with Rudolph's five year evasion of federal forces. Can you think of any reason why an innocent man might run? I sure can!


As covered in the last issue of The Independent American, Americans are finding it too tough to receive a fair trial in the empire's modern tribunal system. Today's "courts" have been guilty of everything from suppression of evidence, violation of the 6th Amendment right to a trial by jury and false imprisonment, to forced medication with psycho-tropic drugs of their victims. And much more!


If you are unlike many Americans today, you might remember back to the first suspect of the Olympic Park bombing, Richard Jewell. Jewell went through weeks of harassment and mental anguish as he constantly had to defend accusations made against him in the press. As if to say, "This must be the guy. He's such an evil person!". Typical government modis operandi.


The controlled press, then moves from the, "He was charged. He ran.", slant to the personal attack. First among these are, "He considered himself a survivalist.". Like that's a bad thing? Let's just say that survivalism will certainly serve you well should you believe that a totalitarian government is looking for you.


One personal attack at a time is not enough for the controlled press. The next zinger comes as, "He had links to the Christian Identity Church.". Most of us are familiar with Christian Identity only through controlled sources, making information on this religion suspect at best. I do not know enough about Christian Identity to debate what they believe and I will not regurgitate other sources about them. I will say; however; that in this great republic, they have the right to worship according to their consciences. Just as the members of the Mount Carmel Church of Waco, Texas and the Weaver family of Ruby Ridge, Idaho had.


As you can see, it is easy to get off the subject as the controlled press throws out accusations in shotgun fashion. Christian Identity does not need to be defended here. The controlled press is making the accusation that Christian Identity is evil and Eric Rudolph had links to them. They must prove these accusations.


Of course, personal attacks are incomplete these days unless the race card is played. The controlled press was not going to drop the ball on this. The term white supremacist is libeled upon all survivalists/pro-Americans and militia groups at every opportunity. No research or true investigative reporting is involved in the use of this term and it is applied to everyone with pro-American feelings.


The above point was driven home and proven when militia leader Johnny Johnstone was accused in writing of being a white supremacist. Johnstone held the paper exposing the article in which the accusation appeared against his face as he posed for a now famous photo. The press' foul up? Johnny Johnstone is black. The "reporter" that wrote the article did no research into it, therefore regurgitated a falsehood into his reporting.


Lacking any evidence that government is willing to provide, the controlled press then moves from personal attack based on mild speculation to personal attack based upon wild accusation.


In a CNN interview, (Shouldn't the mention of CNN be cause for skepticism?), Rudolph's former sister-in-law offered nothing, but outright speculation. Stating that she believed his bombing of abortion clinics was motivated by racism, [Note that she was not corrected in that she should have stated ALLEGED bombings], and that Eric Rudolph believed that a united world was a threat to America. She later admitted that nothing he said or did indicated this. She went on to state that he lived in a very moral and non-threatening manner, but stated that you could just tell that he believed some bad things.


Doesn't sound like any kind of evidence to me or any kind of real reporting. "His former sister-in-law told CNN he is evil, so he must be the guy." If he showed no inclination or made no statements toward violent activism, how could a person "just tell" that Eric Rudolph might be inclined toward them.


We don't know if Eric Rudolph is guilty of anything that he is accused. We do not know if he is innocent. We probably will never know. Such is the state of affairs in America's judicial system today. Rudolph will most likely be convicted for the crimes in any case. It has already been tried in the media and there will be one thing that every juror on the panel will be certain of before his trial even begins. He is an evil man. He must be guilty.


As far as government is concerned, the case of Eric Rudolph is over. He has been captured and tried in the media. All that is left is for the pretense of a trial and other formalities.


The case of Steve Anderson is still open. At least government has not captured him yet. That has not kept them from trying his case in the media and convicting him in absentia in the minds of the more gullible Americans, though.


Steve Anderson was a member of the Kentucky State Militia. He is a communications expert and ran what was termed a "pirate" short-wave radio station. This station offered programming based on a constitutional stance and exposed many lies and corruption expounded by government.


Anderson found a loophole in the FCC code that allowed any American, licensed or unlicensed, to broadcast on radio frequencies during a state of emergency. A state of emergency and, indeed, many emergencies are declared each year by presidential decree. This allows unconstitutional decrees, such as executive orders, color of law statutes, which gives pretense to state and federal governments to violate the rights of Americans.


Steve Anderson's unlicensed short-wave station broadcasted this fact and included many programs that exposed government infringements. The FCC wanted the station shut down, but if brought to court, evidence might have been uncovered exposing government's unlawful decrees. Anderson would only need ask if a state of emergency existed. If the FCC was truthful, it would have to answer yes, which would nullify the FCC's charges, as Americans are allowed unlicensed broadcasting during a declared emergency. If the FCC were deceptive and answered no, government would have had to explain by what authority could they enforce laws which violate the rights of Americans.


The FCC and the rest of government did not want to address this line of defense, so government did what government does. It staged a raid against the unlicensed short-wave station. As it has done to many such stations, government believed it could confiscate the broadcast equipment without charging the owner. Not this time.


I mentioned that Steve Anderson was a member the Kentucky State Militia. What I have yet to mention is that Anderson had available to him the technology to detect the approach of aircraft. On the day of the planned assault, government agents were detected on approach to anderson's property. Anderson alerted the militia, which performed a record breaking quick turn-out in defense of the property.


As government forces approached, they noticed the turn-out of the militia. Government decided not to try the resolve of the militia, turned tail and ran back to their staging area. Plans for a raid were called off.


Due to the strength of militia groups during the Clinton regime, and the saturation of pro-American individuals in Anderson's area of Kentucky, government did not wish to pursue the issue and allowed the short-wave station to continue to broadcast.


Unfortunately, that would not be the end of the matter. Anderson would sometimes travel to patriotic oriented events. He also didn't quite keep his car up to "legal" standards. Anderson would argue that as long as he didn't travel at night and posed no danger to other travelers, there was no constitutional issue with which he could be charged. He may be correct. unfortunately, since one may not argue constitutional rights in a tribunal this was a moot point. Unconstitutional or not, his car had a damaged tail light.


It was on this infraction that a North Carolina highway patrolman pulled Anderson over. We have only the patrolman's word as to what transpired after this. According to the patrolman, he noticed that Anderson was armed. (Not constitutionally unlawful.) He asked Anderson to step out of the vehicle and disarm himself. One thing leading to another, Anderson felt it necessary to unload a magazine of ammo from what was, apparently, a magazine fed SKS into the patrol car. The patrolman later stated that he had never before seen such firepower.


With the patrolman's car disabled, Anderson left the scene in his own car, leaving the patrolman unhurt.


Steve Anderson is still evading federal forces and is on the FBI top ten wanted list. Anderson is not a danger to Americans or to the country he loves. Here's hoping he has some friends out there. To any of those friends concerned, Anderson would be a valuable benefit to a group of Americans needing a communications expert or to set up Citizen aircraft detection radar.


Doctor Charles Sell, DD had a great life in the suburbs of St. Louis, Missouri. A practicing dentist, married and living the American dream, Dr. Sell had it made. Until he was charged in 1997 by the federal government for medicaid and insurance fraud. Since that time, he has been held in a mental health facility inside a federal prison as federal psychiatrists and the courts have declared him incompetent to stand trial.


The problem with Dr. Sell's defense is that there is evidence that will back up his claims. The 1997 insurance fraud charges are not the first time Dr. Sell had come under the notice of the government. Dr. Sell had been a forensic dentist that was called into action to identify bodies after the Mount Carmel massacre of Waco, Texas. It was there that he says he obtained evidence that federal agents had started the fire during the final assault leading to the deaths of 93 people.


Dr. Sell began getting threats and warnings to shut up about anything that transpired at the Waco massacre. Dr. Sell persisted and found himself charged with medicare and insurance fraud. In his defense, Dr. Sell asserted that the prosecution against him by the federal government was tainted and malicious and wished to present evidence of federal threats against him as well as the evidence that federal agents set fire to the Mount Carmel Church. The tribunal disallowed this evidence, and when Dr. Sell insisted upon a fair trial, declared Dr. Sell incompetent.


While being held during the past six years, Dr. Sell asserts that he has been forcefully drugged with psycho-tropic pharmaceuticals, beaten and tortured. The forceful drugging of Dr. Sell is beyond question. Dr. Sell refuses to ingest drugs he does not need, especially mind altering substances as those being fostered upon him. It is also noted that Dr. Sell has had severe side effects from the prescribed substances. Yet, federal prison workers have forcefully administered these drugs into him. Should Dr. Sell ever get a day in a tribunal, it is doubtful that Dr. Sell would get a true defense from a true representative. With mind altering drugs flowing through his veins, it is most doubtful that he will be able to orchestrate any defense of himself.


There is hearsay of beatings as well. There are questions of an incident in which Dr. Sell was being interrogated by a federal magistrate without the presence of his attorney. When Dr. Sell demanded that his attorney be present and had been repeatedly refused, violating his sixth amendment right, he spat in the fed's face. By some reports, Dr. Sell was then handcuffed, taken into a shower room and beaten. This is reported to have happened on more than one occasion. Anyone with hard evidence of this is urged to contact thestaff@theindependentamerican.freeyellow.com.


The Geneva convention recognizes solitary confinement, when not used as disciplinary action for an actual criminal infraction, as torture. Dr. Sell, in his six years of imprisonment, has spent nearly two of those years in solitary confinement. This is a solid argument for torture.


Could Dr. Charles Sell actually be incompetent to stand trial? That is government's position and every psychiatrist they have paid to testify have corroborated that; however; it is not everyone's expert opinion. Dr. Sell has achieved a perfect score on a test used in prison competency restoration. A brief filed by the Association of American Physicians & Surgeons, Inc. also agrees that Dr. Sell is competent.


Why is Dr. Sells still in prison after six years without a trial? Maybe he has been telling us why all along.


An update is needed for the reader concerning the koernke situation. As reported in last issue's column, Mark Koernke had been convicted of absconding from the scene of a crime that "authorities" know without doubt that Koernke could not have committed. Due to suppression of evidence and rehearsal of testimony, the jury rendered a guilty verdict on faulty information.


Mark Koernke had been threatened by a federal agent that if he were convicted, he would not come out of the prison alive. Since his internment, Koernke has been placed in a cell with a known violently unstable inmate. This inmate had a habit of beating and severely injuring cell mates. As was expected by "authorities", this loony attacked koernke. Though Koernke was slightly injured, his hand to hand skills allowed him to survive and walk out of the cell, when guards very belatedly responded.


Mark Koernke continues to labor for the cause of American freedom from within his politically motivated imprisonment. Mark has put together a list of materials that would serve Americans as decontamination material should a chemical or biological attack upon our population occur. Prison authorities found the list and threw Koernke into solitary confinement. They, at first, claimed that the list was for bomb making material. Fortunately, this list was widely known. It contains detergent, bleach, and handy wipes. That's it. These items cannot be assembled into a bomb and this is very well known by those in "authority"!


Mark Koernke is continuing to serve out his sentence for a crime which cannot exist.


Nancy Koernke has stepped into the box to carry on the work of her husband. Her radio broadcasts can be heard on Fridays at 8:00 PM Eastern time on C band satellite, Galaxy 9, transponder 2, 7.3 wideband audio. Her show is called The Kitchen Militia.


No good deed goes unpunished. Government did not like Mark Koernke broadcasting the truth about government and educating Americans on how to survive a police state. Government does not like Nancy Koernke doing the same. Nancy's home was raided late last year by the BATF, (The scum that brought you Waco.). A thinly veiled attempt at intimidation, BATF agents claimed to be looking for "illegal" weapons. A term which cannot constitutionally exist.


Agents of the BATF, then stole several of the family's firearms and has, thus far, refused to return them. When queried on the matter, they claim that one of the firearms may be classed as a machine-gun. Though none of the firearms have been mechanically altered, BATF has been unable to determine the "legality" of the firearm in the five months they have had it in their possession.


Now, Nancy is falling into financial distress. She has had many legal bills in filing appeals for her husband, Mark and forcing the tribunal system to provide transcripts of the crooked proceedings with which they railroaded him. Unfortunately, Nancy is now falling behind in her mortgage payments. It is not often that Independent Americans can step forward and actually have a hand in offering physical help to one who has fallen victim to government corruption, but now, here is an opportunity. If any of you have a few spare federal reserve notes, (FRNs), please send what you can spare to Nancy and her family. Americans have seen government bankrupt many innocent Citizens, like Tucker and DeLorean, to prevent them from expounding justice. For a few spare FRNs, we may be able to keep it from happening here.

The situation over the people's republic of Kalifornia's attack on the right of the people to keep and bear arms is growing. The federal government's ninth district tribunal has ruled that the right of the people to keep and bear arms is not an individual right, but a collective right of the state. This is the stance of the Kalifornia commissars, as well, and Kalifornia has been violating that right clear down to the bone!


Kalifornia has banned more makes and models of firearms than any other tyrannical dictatorship located on the North American continent. They have demanded the surrender of once "legally" owned rifles and have offered millions of tax payer FRNs to offer inducements for their surrender. Kalifornia is pushing gunowners too far.


A petition is being circulated for the recall of the anti-American state's governor, Gray Davis. There are plenty of signatures on the petition and it looks good that the issue will make it's way to ballot; however; we have all witnessed the "accidents" and loss of signatures on such petitions before. (Especially noted in Kalifornia, Chicago, and Louisiana.)


Hope is still alive that this issue can be resolved peacefully; however; due to the corrupt nature of the Kalifornian government, it is doubtful. Kalifornia is apparently hoping to use the federal government modis operandi. When they finally have the courage to outlaw firearms en masse, they hope to intimidate most of their Citizens into surrendering them. After the initial amnesty period, they will move against lone holdouts one at a time, further intimidating others to surrender their property.


Americans must not allow this issue to be settled in this manner. After success in the people's republic of Kalifornia, the commissars will spread this poison throughout the entire country. If there are Americans left in the land of fruits and nuts perhaps there will be enough of them to stand together. Perhaps they will keep their liberty teeth and conduct a guerilla campaign to protect them when tyrannical forces turn out to steal them.


Should this happen, perhaps Americans of other states would set up support lines supplying fellow Americans in need with the food, ammo and medical supplies necessary to maintain such a campaign. Perhaps there are Americans making such plans now. In other States, Americans could be caching equipment and ammo while preparing safe houses and rendezvous areas to thwart tyranny from spreading any further than it already has. Perhaps, after some time, such a campaign will end with the restoration of America's great Constitutional Republic.


Of course, all of this is hypothetical. We would need Americans to pull it off.
